Terms & Conditions

These Terms and Conditions ("Terms") govern the use of the website operated by Capra Adventures ("the Operator", "we", "us") and the contractual relationship between the Operator and any natural or legal person ("User", "Client", "you") who accesses the website or contracts our services. They are drafted in accordance with Law No. 04/L-077 on Obligational Relationships, Law No. 06/L-034 on Consumer Protection and Law No. 04/L-176 on Tourism of the Republic of Kosovo.

1. Acceptance

By accessing this website, by submitting a booking request or by accepting a booking confirmation, you confirm that you have read, understood and agreed to be bound by these Terms in their entirety. If you do not agree, you must refrain from using the website and from contracting our services.

2. The Operator

Capra Adventures is a tour operator registered and established in the Republic of Kosovo, providing guided mountain expeditions and related travel services in the Western Balkan region. Identification, registration and contact details of the Operator are made available upon request and on the Contact page of the website.

3. Services

The Operator markets and organises guided tours, mountain expeditions, related accommodation, transfers and ancillary services as described from time to time on the website. Specific terms applicable to bookings (deposits, payment schedule, cancellation conditions, etc.) are set out in our Booking Conditions, which form an integral part of these Terms.

4. Use of the Website

You undertake to use the website lawfully and in good faith. You shall not, in particular, attempt to gain unauthorised access to any part of the website or its servers, introduce malicious code, or use the website in any way that could damage, disable or impair its operation.

5. Intellectual Property

All content of the website, including but not limited to texts, photographs, illustrations, video material, logos, trademarks and software, is protected by intellectual-property rights belonging to the Operator or to its licensors. Any reproduction, distribution, public communication or transformation of such content without the prior written consent of the Operator is prohibited.

6. Information Accuracy

The Operator takes reasonable care to ensure that the information published on the website (itineraries, prices, photographs, dates) is accurate at the time of publication. However, due to seasonal and operational factors, content may be updated without prior notice. The descriptions provided on the website are indicative and do not constitute a contractual offer until a written booking confirmation has been issued.

7. Pricing and Payment

Prices are expressed in Euro (€) and, unless explicitly stated otherwise, include the value-added tax applicable in the Republic of Kosovo. The price binding upon the parties is the price stated on the booking confirmation. Payment terms, including deposits and final balances, are set out in our Booking Conditions.

8. Liability

The Operator is liable for damages caused by its wilful misconduct or gross negligence in connection with the proper performance of its contractual obligations. The Operator's liability for indirect, consequential or commercial losses is excluded to the maximum extent permitted by law. Nothing in these Terms limits liability for death or personal injury caused by the Operator's negligence, or for any other liability that cannot be limited or excluded under the imperative rules of Kosovo law.

9. Force Majeure

Neither party shall be liable for any failure or delay in the performance of its obligations caused by an event of force majeure, including but not limited to natural disasters, severe weather, epidemics, war, civil unrest, strikes, governmental measures or border closures, in accordance with Articles 343 et seq. of Law No. 04/L-077 on Obligational Relationships.

10. Personal Data

The processing of personal data carried out in connection with the use of the website and the provision of services is described in the Privacy Policy, which forms an integral part of these Terms.

11. Modifications

The Operator reserves the right to modify these Terms at any time. Any modification shall enter into force as from its publication on the website and shall apply to bookings made thereafter. Bookings already confirmed shall continue to be governed by the Terms in force at the time of confirmation.

12. Governing Law and Jurisdiction

These Terms are governed by, and shall be construed in accordance with, the law of the Republic of Kosovo. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Kosovo, without prejudice to any imperative consumer-protection provisions granting jurisdiction to the courts of the consumer's place of residence.
